Enquiry

Invoice and Payment
Once both party’s agree to the fees and want to proceed, an invoice is sent to each party and payment is due a minimum of 14 days before the mediation date.

Documentation and Preparation
A minimum of 10 days before the mediation day, the party’s send a mediation bundle to Echelon which may include particulars of claim and their position statement. Echelon prepares the mediation agreement and distributes to each party and any legal representatives.

Pre-Mediation Meeting
The mediator makes a private call with each party a few days before the mediation. This provides an opportunity to discuss the process, address any questions and ensure all parties are prepared for the session

Mediation Day
The mediation is without prejudice, confidential and takes place either in person or via Zoom, based on the agreed format. The length of the session is usually estimated beforehand i.e. either half a day or a full day. In many cases, a resolution is reached and legal representatives draw up an agreement to be circulated and signed.

Is mediation legally binding in the UK?
Mediation itself is not automatically legally binding. The discussions are “without prejudice,” meaning they cannot be used later in court or tribunal. However, if an agreement is reached, it can be written into a settlement agreement or contract. Once signed, this becomes a legally enforceable document. Do we need lawyers at mediation or just decision-makers?
You do not need to bring lawyers to mediation. What matters most is that each party has someone present who has the authority to make decisions and reach a settlement. Lawyers can be consulted before or after mediation to provide advice or to formalise any written agreement, but their attendance during the session is optional.
What happens if mediation doesn’t settle everything on the day?
Mediation often resolves some issues immediately and narrows the disagreement on others. Partial agreements can be recorded, which reduces risk, cost and time even if everything is not settled at once.
